Welcome to Bonsai Legacy. By using our website and application at bonsailegacy.com, you agree to be bound by these Terms of Service. Please read them carefully.
1. Acceptance of Terms
By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service. We may update these Terms from time to time, and continued use after changes constitutes acceptance.
2. Description of Service
Bonsai Legacy is a web application for managing bonsai collections, tracking care activities, and creating succession plans. We offer both free and paid subscription tiers with varying feature access.
3. Accounts
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 13 years old to create an account.
- One person or entity per account. Shared accounts are not permitted.
- You are responsible for all activity that occurs under your account.
4. Subscriptions & Payments
Free Plan
The Free plan provides limited access at no cost. No credit card is required. Feature limitations (such as the 3-tree limit) may be adjusted at our discretion.
Paid Plans
Paid plans (Collector, Legacy, Lifetime) are billed through Stripe. Monthly and yearly subscriptions renew automatically unless canceled. The Lifetime plan is a one-time payment granting permanent access to Legacy-tier features.
Cancellation
You may cancel your subscription at any time through the billing portal. Upon cancellation, your account reverts to the Free plan at the end of the current billing period. Your data is preserved — nothing is deleted.
Refunds
Subscription payments are generally non-refundable. If you believe you were charged in error, contact us at support@bonsailegacy.com and we will review your case.
5. Your Content
You retain ownership of all content you upload to Bonsai Legacy, including photos, tree data, care logs, and succession plans. By using the service, you grant us a limited license to store, process, and display your content solely to provide the service to you.
We do not access, use, or share your content for any purpose other than operating the service, unless required by law.
6. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Upload malicious files or content
- Attempt to access other users' data
- Reverse-engineer, decompile, or attempt to extract the source code
- Use automated tools to scrape or collect data from the service
- Resell or redistribute the service without permission
7. Service Availability
We strive to keep Bonsai Legacy available at all times, but we do not guarantee uninterrupted service. We may perform maintenance, updates, or experience downtime. We are not liable for any loss resulting from service unavailability.
8. Data & Privacy
Your use of the service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9. Limitation of Liability
Bonsai Legacy is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
Our total liability for any claim arising from the service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Intellectual Property
The Bonsai Legacy name, logo, and application design are our intellectual property. You may not use our branding without written permission. Your content remains yours — see Section 5 above.
11. Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your data will be removed within 30 days.
12. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state in which Bonsai Legacy operates.
